§ 32-19. Purpose.

  • (a)

    The exploration, development, and production of gas and oil in the city are activities which necessitate reasonable regulation to ensure that all property owners, mineral and otherwise, have the right to peaceably enjoy their property and its benefits and revenues. It is declared to be the purpose of this article to establish reasonable and uniform limitations, safeguards and regulations for present and future operations related to the exploring, drilling, developing, producing, transporting and storing of gas, oil and other substances produced in association with gas and oil within the city to protect the health, safety and general welfare of the public, minimize the potential impact to property and mineral rights owners, protect the quality of the environment and encourage the orderly production of available mineral resources.

    (b)

    Whenever the term gas is used in this article, it shall include oil and the terms of this article shall be applicable to the exploration, development, and production of both gas and oil in the city.

    (c)

    To the extent that any provision of this article might be inconsistent or in conflict with the specific provisions of any other ordinance of the city, this article shall control with regard to the conflict.
