§ 40-37. Obstructing streets and sidewalks.

  • (a)

    It shall be unlawful for any person to peddle, sell, solicit, canvass, or take orders for any services, wares, merchandise, or goods, or article of value, including plants, flowers, paintings, novelties, books, magazines, photographs, or any articles for future delivery, within or upon any public street or sidewalk or public right-of-way in any manner which causes any impeding or obstruction of such public street, sidewalk, or right-of-way.

    (b)

    It shall be unlawful for any person to peddle, solicit, hawk, sell, or take orders for or offer to take orders for any item or service on any public street or alley or traffic island.

    (c)

    It shall be unlawful for any person to block or obstruct or hinder the free flow of traffic in the lawful use of a street or highway within the city or the free passage of pedestrians in the lawful use of the sidewalk, street, or public right-of-way. No solicitation, sales, or distribution of merchandise, products, or services, shall be offered or made to occupants of motor vehicles moving or stopped in traffic on a public street or alley.

    (d)

    It shall be unlawful for any person to erect, maintain, or carry any temporary or portable sign within or adjacent to any public street, sidewalk, alley, or right-of-way offering to sell any wares, goods, merchandise, or service. As used in this subsection, sign means an outdoor structure, sign, display, light device, figure, painting, drawing, message, plaque, poster, billboard, or other thing that is designed, intended, or used to advertise or inform.

    (e)

    It shall be unlawful for any person to engage in the ringing of bells, blowing of horns, hawking of goods, or any other noise, practice, or performance directed to persons on a street or sidewalk for the purpose of attracting business, amusement, or otherwise.

    (f)

    It shall be unlawful for any person to engage in any sport, game, or exercise, including baseball, softball, football, basketball, street hockey, or other similar games, in or upon any public street or sidewalk within the city.
