§ 46-217. Exemptions.

  • The following user or operation of a golf cart, all-terrain vehicle or recreational off-highway vehicle shall be exempt from the regulations of this article:

    (1)

    Official city business. The operation of a golf cart, all-terrain vehicle or recreational off-highway vehicle is used by city personnel in carrying out official city business upon a public street with a posted speed limit of not more than 30 miles per hour; provided however, that city personnel cannot drive up and down arterial streets, F.M. 156 or F.M. 407;

    (2)

    Transportation to/from city facilities. The operation of a golf cart, all-terrain vehicle or recreational off-highway vehicle upon a public street with a posted speed limit of not more than 30 miles per hour for transportation of city personnel to or from city facilities; provided however, that city personnel may cross an intersection, including a road or street that has a posted speed limit of more than 30 miles per hour as authorized by the state transportation code, as amended;

    (3)

    City property. The operation of a golf cart, all-terrain vehicle or recreational off-highway vehicle on property owned or leased by the city for the maintenance and upkeep of city facilities; or

    (4)

    Parade, festival or special event. The operation of a golf cart, all-terrain vehicle or recreational off-highway vehicle when the vehicle is used in connection with a parade, festival or other city authorized or sponsored special event.
