§ 48-1. Sanitary control area around water wells and public water supply sources.

  • (a)

    Established. The city has established a sanitary control area of 150 feet horizontal distance around each water well and public water supply source, or within 50 feet of any property line of such well or source, in the city.

    (b)

    Construction and commercial operations restricted. The construction and operation of underground petroleum and chemical storage tanks and liquid transmission pipelines, stock pens, feed lots, dump grounds, privies, cesspools, septic tank or sewage treatment drain fields, dry litter poultry facility, improperly constructed water wells of any depth, and all other construction or operation that could create an unsanitary condition within, upon, or across the sanitary control area, a water well or public water supply source of the city, are prohibited within the sanitary control area. The construction of tile or concrete sanitary sewers, sewer appurtenances, septic tanks, storm sewers, water-tight sewage and liquid-waste collection facilities and cemeteries is specifically prohibited within a minimum horizontal 50-foot radius of any such water well or public water supply source in the city. If the restrictions of this section are complied with, construction of homes or buildings within the sanitary control area is permitted.

    (c)

    Farming and ranching operations. Normal farming and ranching operations are permitted within the sanitary control area, provided that livestock may not be kept or allowed to be within 50 feet horizontal distance of a water well or public water supply source in the city.
