§ 48-172. Definition of terms.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Biochemical oxygen demand (BOD) means the quantity of oxygen expressed in parts per million parts by weight, utilized in the biochemical oxidation of organic matter under standard laboratory conditions for five days at a temperature of 20 degrees Celsius. The laboratory determination shall be made in accordance with procedures set forth in Standard Methods.

    Building drain means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, wastes, and other drainage pipes within the walls of the building, and conveys it to the building service connection, beginning three feet outside the inner face of the building wall or foundation.

    Building service connections means the extension from the public sewer in the street, alley or easement, or other lawful place of disposal, to the building drain.

    City means the city, or any duly authorized representative acting in its behalf.

    City secretary means the chief executive officer of the city or his duly authorized representative acting in his behalf.

    Domestic sewage or domestic wastewater means waterborne wastes normally discharging into the sanitary conveniences of dwellings (including apartment houses and hotels), office buildings, factories and institutions, free of stormwater, surface water and industrial wastes.

    Garbage means solid wastes and residue from the domestic and commercial preparation, cooking, and dispensing of foods and for the handling, storage, and sale of food products and produce.

    Hazardous metal means any of the following metals in its elemental state and any of its compounds expressed as that metal: antimony, arsenic, barium, beryllium, bismuth, boron, cadmium, chromium, cobalt, copper, iron, lead, manganese, mercury, molybdenum, nickel, selenium, silver, tin and zinc.

    Health officer means the duly elected or appointed health officer of the city or his duly authorized representative acting in his behalf.

    Industrial wastes means the waterborne combination of solid, liquid, or gaseous wastes from industrial manufacturing and storage, commercial, or processing operations, or from the development of any natural resource, or any mixture of these with water or domestic sewage as distinct from domestic sewage.

    Natural outlet means a point of discharge into any receiving water such as a watercourse, pond, ditch, lake, or other body of surface water or groundwater.

    Normal domestic sewage or normal domestic wastewater means domestic sewage for the city for which the concentration of suspended solids is established as 200 parts per million parts by weight and for which the concentration of five-day biochemical demand (BOD) is established as 250 parts per million parts by weight.

    Person means any individual, firm, company, association, estate, trust, society, corporation, partnership, or group, their agents, servants or employees.

    pH means the logarithm (base ten) of the reciprocal of the hydrogen ion concentration expressed in MOLS per liter. It shall be determined by one of the procedures outlined in Standard Methods.

    Properly shredded garbage means the wastes from the preparation, cooking, and dispensing of food that have been shredded to such degree that all particles shall be carried freely under the flow conditions normally prevailing in public sewers, with no particles greater than one-quarter inch in any dimension.

    Public sewer means a sewer in which all abutting properties shall have equal rights under its control by a public authority.

    Sanitary sewer means a public sewer which carries sewage or wastewater and to which stormwaters, surface waters, and groundwaters are not intentionally or legally admitted.

    Sewage or wastewater means a combination of waterborne wastes from residences, business buildings, institutions, and commercial and industrial establishments, together with such groundwaters, surface waters and stormwaters as may be present.

    Sewage treatment plant or wastewater treatment plant means any arrangement of devices and structures used for the treatment of sewage.

    Sewage works means all facilities for collecting, transporting, pumping, treating, and disposing of sewage or sewage processing materials or waste.

    Sewer means a pipe or conduit for carrying sewage or wastewater.

    Standard Methods means the laboratory procedures set forth in the latest edition, at the time of analysis, of Standard Methods for the Examination of Water and Wastewater, as prepared, approved, and published jointly by the American Public Health Association, the American Water Works Association, and the Water Pollution Control Federation.

    Storm sewer or storm drain means a sewer which carries stormwaters and surface waters and drainage but excludes domestic sewage and industrial wastes.

    Stormwater means the surface and subsurface water created by rainfall or any other of the forms of precipitation.

    Suspended solids means the quantity of those solids, expressed in parts per million parts by weight, that either float on the surface of, or are in suspension in the water, sewage, or other liquids, and which are removable by a laboratory filtration device in accordance with procedures set forth in Standard Methods.
