§ 48-234. Original jurisdiction.

  • (a)

    The city does elect to have the state public utility commission exercise exclusive original jurisdiction over electric utility rates, operations, and services within the existing and future incorporated limits of the city.

    (b)

    The city expressly retains the exclusive original jurisdiction over the rates, operations, and services of water and sewer utilities within the existing and future incorporated limits of the city.

    (c)

    The ordinance from which this article is derived shall become effective, and the state public utility commission shall exercise the exclusive original jurisdiction over the electric utility rates, operations, and services on and after October 13, 1980.

    (d)

    The city secretary shall give notice of this article to the state public utility commission by forwarding a certified copy of same to the state public utility commission upon the passage of this article.
