§ 38-25. Storage of solid waste.

  • (a)

    Garbage. It shall be the duty of every person owning, managing, operating, leasing, renting, or occupying any premises to place municipal solid waste in bags, place recyclable materials in recycling containers, and place such bags or containers within five feet of the curbside or right-of-way adjacent to a single-family residential unit no later than 7:00 a.m. on the scheduled collection day. Notwithstanding the above, the service provider shall not be obligated to collect in excess of one cubic yard of municipal solid waste from any single-family residential unit during any collection.

    (b)

    Rubbish. It shall be the duty of every person owning, managing, operating, leasing, renting or occupying any premises to place rubbish from the premises in garbage cans or containers capable of easy handling, if possible to do so; provided, however, that rubbish such as tree limbs or other articles that cannot easily be placed in containers shall not be required to be so placed.

    (c)

    Placement. Garbage cans and other receptacles containing garbage and rubbish shall be kept on a person's premises at the rear of the structure on such premises in accordance with this article, and on the day or days designated by the city council for collection, the containers shall be placed at the front edge of the premises from which site the solid waste collector shall collect the contents of the garbage cans or other receptacles. At no time shall any solid waste be placed by or in a public highway as defined herein, except that on collection days, the receptacles shall be placed behind the curb, or if there is no curb, then beside but not in the public highway in front of the premises; provided, however, that as to any premises zoned commercial or industrial and having a public highway open to the public for vehicular traffic adjoining the rear of the premises, all garbage cans or other receptacles used to store solid waste shall be placed at the rear edge of the premises in accordance with this article on the day or days designated by the city council for collection of solid waste. Where a commercial or industrial operation generates a volume of solid waste requiring more frequent collection than designated by the city council for normal collection of solid waste, the person charged with the operation of the premises shall arrange for the necessary disposal of the solid waste in accordance with this article.

    (d)

    Miscellaneous. Except as provided in this article, the service provider shall only be responsible for collecting, hauling, and disposing of municipal solid waste and recyclable materials placed inside bags or recycling containers. Municipal solid waste in excess of the bag's limit, or placed outside or adjacent to a bag, and recyclable materials placed outside or adjacent to a recycling container, will not be collected by the service provider. However, such excess or misplaced municipal solid waste and recyclable materials may be collected on occasion and within reason due to holidays or other extraordinary circumstances as determined by the service provider in its discretion. The service provider will collect municipal solid waste from commercial, industrial and multifamily units if such waste is placed in containers furnished by the service provider.
